ProGrade Dumpsters (ProGrade Operations, LLC)

1. Overview

These Terms of Service govern all dumpster rental services provided by ProGrade Dumpsters. By booking, paying for, or using our dumpsters, you agree to these terms.

2. Service Eligibility

You must:

• Be at least 18 years old

• Have legal authority to enter into this agreement

• Provide accurate information when scheduling a rental

3. Rental Periods

Rental periods are defined at booking. Extensions, early pickups, and swap-outs may be subject to additional fees. Rental time continues until the dumpster is picked up, even if it is no longer being used.

3.1. Rental Extensions

Extension charges apply after the standard rental period.

4. Deliveries & Pickups

4.1. Delivery Requirements

Customers must:

• Provide accurate placement instructions

• Ensure the delivery area is accessible, stable, and free of hazards

• Obtain any necessary permits (if required by the city or county)

We are not responsible for damage to driveways, yards, or surfaces caused by normal delivery or retrieval.

4.2. Pickup Requirements

The dumpster must be:

• Accessible at the scheduled time

• Not overloaded (overloaded bins will not be hauled due to safety and legal reasons)

• Not filled above the rim

• Debris must not be hanging off sides

• Doors are to be closed and secure

Failure to meet these conditions may result in extra fees or rescheduled pickup.

4.3. Access & Return Trips

A pickup or delivery attempt requires clear access to the dumpster.

If blocked or unsafe, a Return Trip Fee + Extra Day Charge will apply.

5. Prohibited Materials

Customers are strictly prohibited from placing the following into any dumpster:

• Hazardous waste (chemicals, oil, paint, solvents)

• Tires

• Batteries

• Asbestos-containing materials

• Medical waste

• Propane tanks

• Explosives or flammables

• Refrigerators or appliances containing Freon (unless pre-approved)

If prohibited items are found, the customer is responsible for all associated fines, disposal costs, and handling fees.

6. Weight Limits & Overage Fees

Each dumpster includes a weight allowance specified at booking.

If the dumpster exceeds its allowed tonnage, overage fees will be billed at the posted per-ton rate.

The landfill’s weight ticket is final and used to calculate any overages.

7. Customer Responsibilities

Customers agree to:

• Use the dumpster safely and legally

• Prevent unauthorized dumping by others

• Avoid moving the dumpster once placed

• Not overload or overfill the dumpster

• Keep the dumpster clear of debris around the exterior

• Cover the dumpster in heavy rain or wind when possible

Any damage to the dumpster caused by misuse is the customer’s responsibility including, but not limited to :

• Damage to dumpsters

• Damage caused by improper loading

• Damage caused by restricted waste

• Damage caused by overfilled or imbalanced loads

8. Property Damage Disclaimer

We are not responsible for damage to:

• Driveways (concrete, asphalt, gravel)

• Lawns, yards, or landscaping

• Sidewalks or pathways

• Underground lines not identified in advance

You authorize our driver to enter your property for delivery and pickup at your risk.

9. Payment Terms

Payment is required before the dumpster is delivered unless previously arranged.

Additional fees may apply for:

• Overweight loads

• Rental extensions

• Dry runs (arriving and the dumpster is inaccessible)

• Contamination by prohibited materials

• Swap-outs

• Extra pickups

• Relocation of the dumpster after delivery

Unpaid balances may be sent to collections.

9.1. Payment Authorization

• A card must be kept on file.

• Customer agrees ProGrade Operations may automatically charge fees as outlined in the rental agreement.

• Photo documentation will be provided for all additional charges.

10. Cancellations & Refunds

10.1. Cancellations

Cancellations must be made before the driver is dispatched. If cancelled after dispatch, a $50 trip fee may apply.

• No-show or no access = Return Trip Fee + Extra Day Charge

10.2. Refunds

Refunds are issued only if ProGrade Dumpsters fails to provide the booked service. Rental time that goes unused after delivery is non-refundable.

11. Service Availability

Service may be delayed or suspended due to:

• Weather conditions

• Equipment issues

• Landfill closures

• Unsafe delivery conditions

• Driver availability

We are not liable for delays outside our control.

12. Liability Limitation

To the maximum extent permitted by law:

• ProGrade Dumpsters is not responsible for indirect or incidental damages

• Total liability is limited to the amount paid for the rental

• Use of the dumpster is at the customer’s own risk

13. Indemnification

Customers agree to indemnify and hold ProGrade Dumpsters harmless from claims, damages, or penalties arising from:

• Misuse of the dumpster

• Loading prohibited items

• Damage caused by the dumpster placement

• Violations of local laws or ordinances

14. Changes to Terms

We may update these Terms at any time. The “Last Updated” date indicates the current version. Continued use of our services confirms acceptance of the updated terms.
